Services Offered - Boundary Disputes

Boundary disputes can involve very entrenched positions and firm views held by the opposing parties which are not easy to shift. In many cases the position adopted by the parties is motivated by significant potential financial gain, in others by frustration.

We offer two services.

Instruction by a single party

We advise property owners on direct instruction or through solicitors to resolve disputes. We review title deeds, plans, photographs and other documents and undertake site inspections and measurements to prepare plans where appropriate or necessary and attend meetings to assist in resolving issues.

Instructions by RICS or Joint Instructions by the parties

David Linnell has been recognised as an expert in this field and is appointed to the panel of Experts under the RICS Neighbour Dispute Service. He receives appointments from the President of the RICS.

The Scheme is in three stages. It is expected that in most cases the first stage will result in an agreement between the parties. If that is not achieved the parties can agree to move on to stage 2 and if necessary stage 3.

The Scheme is designed to be cost effective with fixed fees for each stage.

Stage 1 is an Expert Evaluation. Stage 2 is a quasi mediation with a view to creating a consensus agreement. Stage 3 is an Expert Witness Report prepared for the Court.

David Linnell will undertake a similar instruction jointly from the parties or their solicitors.
